Geek & Grub Market Rules & Policies

VENDOR EXPECTATIONS

Vendor Provisions
Vendor understands that they must provide their own tent, tables, chairs, weights, portable fire extinguisher (for Raleigh Events) and displays. No electricity will be provided.

 

Early Breakdown
Vendor understands that there are no early breakdowns permitted. Vendor understands that they must stay set up until the specified end time for the event.


No Trash Left Behind
Vendor understands that their vendor space must be completely cleared of trash and supplies upon their departure. Host reserves the right to issue fines for excessive trash left by Vendor.


Vandalism
Vendor understands that they or their representatives must not injure or deface the grounds of the Market venue. If such damage occurs, Vendor will be liable to the owner of the property damaged and face possible fines from Host.


Booth Sharing
Vendor understands that they may share a booth with (1) one other vendor. The vendor you wish to share with must be listed in the application when applying for an event. If sharing a booth with another vendor, they are limited to a max total of three types of items NOT three items per vendor. 


Booth Transfers
Vendor understands that the Geek and Grub will not facilitate Booth Transfers and Vendor is responsible for finding their own replacement. The deadline for booth transfers is 30 days before the scheduled event. In order to obtain a booth transfer you must email us a Transfer Request to Erin@GeekandGrubMarket.com for review and approval. Not all transfers will be approved, and management reserves the right to curate the market as needed.


 Cancellation or Change of Venue or Date(s) due to Inclement Weather
Vendor understands that this event is taking place outside and will be taking place RAIN OR SHINE. Vendor understands and acknowledges that the 'Host' shall not be responsible for delays, damage, loss, increased costs, or other unfavorable conditions arising out of causes not reasonably within the control of the Host including without limitation, fire, casualty, flood, epidemic, earthquake, explosion, accident, blockage, embargo, inclement weather, government restraints, act of public enemy or civil disturbance, impairment, or lack of adequate transportation, inability to secure sufficient labor, technical or other personnel, municipal, state, or federal laws, or acts of God. Should the Host cancel, relocate, and/or delay the Market pursuant to any of the foregoing, Vendor hereby waives any and all claims for injury, loss or damage arising there from.


Fire Extinguisher Required
Vendor understands that according to NC FIRE CODE 2404.12 they must provide their own portable fire extinguisher at their tent at all events in the City of Raleigh.


Theft and Damage
Vendor understands that they are solely responsible for their own booth material and should insure against loss or damage. Host is not responsible for such loss or damage. Vendor must secure all items of value. Vendor understands that all of their property is to remain in their care, custody and control in transit to and from, and within the confines of the event area.


Use of Photo/Video
Vendor authorizes Host to use their profile, pictures, website content or any publicly available information about their business on Host’s affiliates website or advertisements. Vendor further authorizes Host and Host’s agents to take photo and video of the Event, Vendor, and Vendor’s products for website or advertisement purposes.


No Refunds
Vendor understands that booth fees are non-refundable. Host cannot guarantee the weather, the size of the crowd, or otherwise assure against potential disaster.


Liability Insurance
It is highly recommended that Vendors obtain their own liability coverage. Vendors are responsible and liable for any damages to themselves, their setup, and their products.


Sales Tax
All Vendors in the Market must have a Sales Tax ID as provided by the North Carolina Department of Revenue. All Vendors are required to file/pay their applicable Sales Tax per NC DOR regulations.


COVID-19 Policy
Vendor understands that Host will adhere to all COVID-19 related state and/or city regulations and may impose other rules for the safety of their vendors and guests. Vendor understands that they are expected to follow all rules set forth; Host will keep Vendor updated as to the status of these events.


Right to Refuse
Vendor understands that Geek and Grub Market dba Triangle Game Night and Events LLC reserves the right to refuse, cancel, or suspend vendor admission to future events at our sole discretion.

Discrimination
Discrimination based on race, color, religion, sex (including pregnancy, sexual orientation, or gender identity), national origin, disability, age (40 or older) or genetic information (including family medical history) is illegal and will not be tolerated.


ADDITIONAL LEGAL PROVISIONS


Limitation of Liability
IN NO EVENT SHALL HOST BE RESPONSIBLE OR LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, ARISING OUT OF OR RELATING TO ANY BREACH OF ANY PROVISION OF THIS AGREEMENT, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT HOST WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT, OR OTHERWISE) UPON WHICH THE CLAIM IS BASED, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE. IN NO EVENT SHALL HOST’S AGGREGATE LIABILITY UNDER THIS AGREEMENT EXCEED THE TOTAL OF THE FEE PAID TO HOST HEREUNDER.
